Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the Eddys Development website and the services we provide through it (together, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Acceptance of these Terms
By creating an account, submitting a project request, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you are using the Services on behalf of a business, you represent that you are authorized to accept these Terms on its behalf.
2. About Eddys Development
Eddys Development (“we,” “us,” or “our”) is an independent studio that designs and builds mobile apps and websites and provides related services. The Services include this website, account registration, and the ability to submit project inquiries. Any paid development engagement is governed by a separate written agreement between you and us, which controls if it conflicts with these Terms.
3. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account or submit a request. By using the Services, you represent that you meet this requirement and that the information you provide is accurate.
4. Your account
When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us promptly at eddysdevelopment@gmail.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Acceptable use
When using the Services, you agree not to:
- Violate any applicable law or regulation, or infringe the rights of others;
- Upload or transmit malware, or attempt to gain unauthorized access to the Services, accounts, or systems;
- Probe, scan, scrape, overload, or otherwise interfere with the Services or their infrastructure;
- Submit false, misleading, or fraudulent information, or impersonate any person or entity;
- Use the Services to harass, abuse, or harm others, or to send spam or unsolicited messages.
6. Project requests and quotes
Submitting a project request through our form is an inquiry only. It does not create a binding contract, reserve our services, or obligate us to perform any work. A binding engagement is formed only when both parties agree to a separate written proposal or agreement. We may decline any request at our discretion.
7. Intellectual property
The Services, including the Eddys Development name, logo, design, text, and software, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose.
You retain ownership of the content and information you submit to us (for example, the details of a project request). By submitting it, you grant us a license to use that content as needed to operate the Services and to respond to and evaluate your request.
8. Third-party services
The Services rely on third-party providers, including Supabase for database, authentication, and hosting, and an email provider for sending transactional messages. Your use of the Services may be subject to those providers’ terms and policies. We are not responsible for third-party services and do not endorse them.
9. Disclaimers
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Eddys Development will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim, or USD $100.
11. Indemnification
You agree to indemnify and hold harmless Eddys Development from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or of any law or third-party right.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be communicated where appropriate. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Services will be resolved in the courts located in the State of Florida, United States, and you consent to their jurisdiction. Before filing a claim, you agree to first contact us at eddysdevelopment@gmail.com to attempt to resolve the matter informally.
